A Wirral taxi driver has had a littering conviction overturned after initially being accused of dropping a cigarette butt.
Chris Jones decided to take on Kingdom Services Group after he was fined £300 and ordered to pay £300 costs at Sefton Magistrate's Court.
The alleged offence, which took place on 26 October 2018, saw Mr Jones confronted by a Kingdom Services employee and accused of dropping a cigarette butt in Tranmere, despite the cab driver vaping at the time.
The cabbie told the Liverpool Echo that the operative knew that he was smoking an e-cigarette, and alleged that he just wanted to get his bonus.
Kingdom, whose contract with Wirral Council has been terminated by mutual consent, subsequently had the cabbie prosecuted.
Mr Jones, however, did not take the conviction lying down, employing a solicitor to get the conviction overturned.
Liverpool Crown Court heard the appeal and the conviction was subsequently quashed.
