How CU80 mobile phone convictions affect taxi licence applications

A CU80 conviction for using a hand-held mobile phone while driving can present a significant hurdle for taxi and private hire driver applicants, with many councils treating the offence as a major traffic matter.


The offence carries six penalty points and a financial penalty under road traffic law. For professional drivers, the regulatory implications often extend beyond the court sentence. Licensing authorities regard mobile phone use at the wheel as a direct road safety risk, particularly given the responsibility of transporting fare-paying passengers.

Under most taxi licensing policies, a CU80 endorsement falls within the category of major traffic offences. This classification typically means an application cannot be determined under officer delegation and must instead be considered by a Licensing Sub-Committee.


In assessing such cases, councillors focus on the “fit and proper person” test. They will examine the circumstances of the offence, how recently it occurred and whether it forms part of a wider pattern of driving behaviour. An isolated incident may be weighed differently from repeated endorsements within a short timeframe.

Timing and disclosure of the offence are critical as applicants are generally required to declare all convictions during the application process. Where a CU80 offence is discovered through DVLA checks rather than proactive disclosure, panels may view this as an aggravating factor.


Some councils apply benchmark periods, often requiring a defined span free from further convictions before granting a licence. However, these are guidelines rather than automatic bars. Mitigation, remorse and evidence of improved driving standards can influence the final outcome.

For the sector, the treatment of CU80 convictions reflects the broader safeguarding approach set in the statutory Taxi and Private Hire Vehicle Standards. Mobile phone use while driving is seen as incompatible with the heightened duty of care expected of licensed drivers.


Applicants with a CU80 endorsement are not automatically excluded from the trade, but they should expect heightened scrutiny and a detailed examination of their driving history before a decision is reached.
