Liverpool enforcement officers warn licensed drivers to comply with smoke-free vehicle laws after unpaid fixed penalty leads to significant court fine.


A Sefton-licensed private hire driver has been ordered to pay £450 after failing to settle a £30 fixed penalty issued for smoking inside a licensed vehicle, according to Liverpool City Council’s licensing enforcement team.

The incident was highlighted by Liverpool City Council Licensing officers on social media, confirming that the driver had initially been issued with a Fixed Penalty Notice for breaching smoke-free legislation that applies to licensed vehicles used for public hire.


Under the regulations, smoking is prohibited in all licensed taxis and private hire vehicles in England. Drivers found breaching the law can be issued with a fixed penalty, typically set at £30 if paid promptly.

In this case, the driver failed to pay the original notice, prompting enforcement officers to escalate the matter through the courts. The case was heard last week, where the driver was ultimately fined £450 including court costs.


Liverpool City Council Licensing said the outcome demonstrates the potential consequences of ignoring enforcement action. What began as a relatively minor fixed penalty increased substantially once the case proceeded through the legal system.

Licensed taxi and private hire drivers are subject to smoke-free vehicle requirements under public health legislation, which aims to protect passengers from second-hand smoke exposure. The rules apply whether or not passengers are present in the vehicle at the time.


Local authority licensing teams regularly carry out compliance checks and can issue fixed penalties where drivers are found smoking in their vehicles. Failure to comply with notices can lead to court proceedings and significantly higher financial penalties.
