Torbay licensed taxi driver suspended for three months after committee reviews 19 complaints in six week period

A Torbay licensed taxi driver has been suspended for three months after councillors concluded that a series of complaints and corroborated evidence showed the driver was not currently fit to hold a Hackney Carriage Driver’s Licence.
The decision, reached at a Regulatory Sub-Committee hearing on 6 November, followed a review prompted by 19 complaints raised within just six weeks.
Members were told by the Licensing Officer that the number and rapid frequency of complaints was unprecedented in his experience. The allegations included unsafe driving, sleeping in the vehicle while on duty, incorrect queueing on taxi ranks, refusals to accept card payments or carry passengers, and reports of poor attitude and aggressive behaviour. CCTV submitted to the council showed two driving incidents that committee members regarded as unsafe.
The driver, supported by a representative at the hearing, rejected the allegations. They argued that some interactions stemmed from hostile behaviour by other drivers and said they was unaware of the requirement to display a permit at Paignton railway station. They also claimed that the videoed incidents did not place anyone at risk and noted that one occurred whilst no passenger was on board.
Subcommittee orders immediate suspension and mandatory training following concerns over driving standards and behaviour
After considering the evidence, members concluded that the pattern of behaviour, supported by multiple sources across different taxi ranks and operational partners, demonstrated a level of conduct and driving skill falling short of that expected of a licensed professional. They rejected the suggestion of a coordinated campaign against the driver, given the varied origins of the complaints.
Citing Department for Transport statutory guidance and the Institute of Licensing’s suitability framework, the subcommittee determined that public safety required immediate suspension under Section 61 of the Local Government (Miscellaneous Provisions) Act 1976. The committee directed the driver to complete a RoSPA Level 2 Advanced Driving qualification and a Level 2 customer service course before returning to work. Successful completion would allow the suspension to end early.
Members also instructed the driver to familiarise themselves with Torbay Council’s Taxi and Private Hire Policy and to carry a copy in the vehicle once reinstated. No action was taken against the Hackney Carriage Proprietor’s Licence. The panel concluded that the measured suspension and compulsory training were necessary to restore confidence in their ability to operate safely and professionally.
